    Answer is comparative negligence.

    Explanation:

Comparative negligence is very important in a situation whereby an accident occurs, because, it shows or explains that the negligence and fault of the two parties involved will be judged or based on their contributions to the accident.

In this case, the manufacturer is trying will try to claim that the accident occurred not particularly because of the defected tire but, maybe due to the negligence of Harvey.
