    The Equal Pay Act requires that men and women be given equal pay for equal work in the same establishment. The jobs need not be identical but they must be substantially equal.

    Differences in pay under Equal Pay Act, 1963 are permitted only when they are based on grounds of seniority, merit, quantity or quality of production. These are known as affirmative defenses and it is employer's duty to prove that they apply.

    Pay discrimination based upon gender or pregnancy is prohibited under Equal Pay Act.

    The only factor which can strengthen the differential pay scale can be of Mark working in the night shift.
