A female restaurant employee is on the phone in the kitchen talking to her mother. The chef of the restaurant comes up to the employee, throws off his chef's hat, grabs both the employee's arms, and begins shaking her violently and screaming at her. She reports this to the police. She is later terminated and sues for gender discrimination. Will she win? Why or why not?

    The female restaurant worker is unlikely to win a trial against her employer because of gender discrimination. The chef's attack in the kitchen could have been reported to the U. S. Department of Labor so the corrective actions could have been taken. However, she was not attacked by the chef because she was a female; it is because she was talking on the phone - which could be considered a fault at work and is possibly the reason why she was fired.

    Thus, the female worker does not have any proof she can present about her coworkers or employer treating her differently or discriminating her because of her gender.

    Explanation:

    First of all she could have won if the case was based on the assault and not about gender discrimination.

    Well spending the office timings for one's personal needs is wrong as well, she wasn't doing anything productive however, it gave no right to chef to assault her like that, which was totally wrong. That is why i mentioned above that if she had sued the employer for assault it would have been more easy. And to be honest whole scenario doesn't prove that it had to something about gender discrimination.
