Bee Hive Farms ordered some ventilated suits from Martin. Both are merchants. Martin sent Bee Hive Farms an invoice, which stated that a certain charge would be added to any unpaid bills. The set charge was a common percentage in the industry. Bee Hive Farms failed to pay for the suits. Subsequently, it received another invoice, containing the late charge. Bee Hive Farms did not object to the charge and did not pay the bill. Martin sued Bee Hive Farms for breach of contract. Bee Hive Farms, however, claimed that it did not agree to the late charge.
