Harry was on the phone negotiating the terms of a contract for the purchase of 12 dozen ball caps containing his university's logo with all logos, llc. they had agreed on the quantity and price, but could not agree on the delivery date, so harry hung up. a few days later, harry received an invoice in the mail, billing him for the caps, and advising that they would be shipped in 30 days' time. under the statute of frauds, has a contract been formed?

    Since there does not seem to be an agreement and understanding made on the full terms of the contract and then it signed, a contract has not been formed. All items must be agreed on and signed in some way to make sure they both understand what type of contract they have. A contract is a legally binding document and should be treated as such.
