Why was the legality of segregated schools unclear when the 14th Amendment was established? The "separate but equal" doctrine maintained equality in public education. The 14th Amendment was intended to end racial barriers related to voting, not education. Public education was structured very differently when the Amendment was passed. There was no inequality in public education when the Amendment was passed.
