Questions arise about the position of the courts in American democracy for any number of reasons. These could include the legitimacy of how judges are selected, the process by which they make decisions about laws, or how the Supreme Court decides to rule or not rule in cases. There are many areas where there is still great debate over the role of the judiciary in American democracy.
