    (2) that the commerce in question is not such as to require national or uniform regulation,

    (3) that the state's interest in regulating such commerce is not outweighed by that of the federal government.

    The Framers find these clauses necessary:

    -to address the specific challenges facing the nation during their lifetimes

    -to establish the foundational principles that would sustain and guide the new nation into an uncertain future

    -to regulate Commerce with foreign Nations, and among the several States, and with Indian Tribes.
