Marshall and Jefferson present two diametrically opposed views of the nature of constitutional interpretation, and it is regrettable that Marshall's view has been virtually uncontested in the United States during the past century;

He promoted a position based upon the principle of "judicial review", which is basically the fact that the actions of the executive and legislative branches of the government may be reviewed, and if required, determined invalid. This kind of review allows the Supreme Court to make sure that the branches of government act according to what the constitution states. John Marshall favored the supremacy of the federal government over state authorities, in general.
