He did not want to support the confederates, which to him stood for white supremacy, and instead all Buning wanted was to be reunited with his wife and child. As he arrived in Kentucky he was stopped by the Military, where he accepted a command as the chaplain of the Eight Texas Cavalry and provided services to one of the most renown regiments in the American Civil War.
