Ater, the attorney learned from another attorney that the second attorney had agreed to represent the beneficiary. the attorney discussed the beneficiary's position with the second attorney, advising the lawyer of what she believed were some weaknesses in the case.

    Since she breached a duty of confidentiality she owed to the beneficiary, the attorney who elected not to represent the beneficiary did not behave properly.

    Solicitors are obliged to respect the privacy of their client's affair in the duty of confidentiality.

    Since any information that attorneys get about their clients' affair may be private, these must not be used for the benefit of people that are not authorized by the client.
