The supreme court used the following phrase when it legalized segregation in Plessy vs. Ferguson

    D) That African Americans could be "separate but equal".

    Explanation:

Homer Plessy was of mixed ancestry. In 1892, he boarded a railroad travelling between New Orleans and Covington, Louisiana and sat in the all-white compartment. The conductor asked him to move to the compartment meant for colored people, which Plessy denied. The case appeared to the court before Judge Ferguson who stated that railway companies to have coaches that provide equal but separate accommodations for white and colored passengers. This ruling further applied to other public facilities as well - schools, theaters, restaurants, hospitals, restrooms, etc.
