    It would have to go through Congress for approval. The president does not have the power to declare war. He must first get the approval of Congress who must deliberate on the issue. If it sees that there is enough justification to do so then it would grant the President the authority to declare war. This is found in Article I Section 8 of the Constitution of the United States of America.
