    During WWII there was a couple who were distributing leaflets urging people to peacefully disobey the draft. He was arrested and charged under the Espionage Act of 1917. The Constitutional Question before the court was does his conviction under this act violate his First Amendment Freedom of Speech.

    The court decided unanimously that the free speech clause does not shield advocacy urging conduct deemed unlawful under the Act.
