    Article 48 - Presumption of innocence and right of defence of the EU Charter of Fundamental Rights says that:

    1. Everyone who has been charged shall be presumed innocent until proved guilty according to law.

    2. Respect for the rights of the defence of anyone who has been charged shall be guaranteed.

    Namely, the right to a defense as a basic right of the accused regardless of the qualification of cases as includes several individual rights, the basic characteristic of which is that they are solely for the purpose of defense.

    Example of legal system where this is available is Belgium.
