The Faragher decision dealt with workplace sexual harassment. This was one of the topics not covered under the Civil Rights Act, so it required the High Court to make a decision based upon the spirit of the law, instead of ruling strictly on the letter. This was one way that the Court is able to apply new cultural ideas to older pieces of legislation.
