    The Justice Fortas was an associate justice of supreme Court of the United states. In 1965 after the principals of the schools warned the students that they would be suspended if they wore the armbands. But the students wore the armbands and with parental support fought the school district in court to uphold their First Amendment right to express their opposition to the war in school in the manner in which they did. During this case case Justice Fortas ruled in favor of the students for the following basic reasons:

    The justices reasoned that neither "students nor teachers shed their constitutional rights to freedom of speech or expression at the schoolhouse gate justices noted that the school officials specifically targeted anti-war armbands, but did not prohibit the wearing of any other symbols conveying a political message
