The main reason is because, the prohibitory act is the beginning of the agressions against the Colonies, in which the British Parliament orders a blockade of American vessels, which was responded with a letter of marque, which is in short words a permission to capture vessels to a private party, as a retaliation to the blockade, this wasnot decided on the Second Continental Congress.

    On the other hand, the Declaration of Independence was the consequence of the sum of tensions between America and Britain, which had not ended by the time the Second Congress met. And certainly, the intention of the Second Congress was not to find ways to address grievances from colonists, but how to fight the inminent British agression, actually, the Second Congress authorized the issuing of money to finance the Continental Army.
