    I am pretty sure it is the Prosecution

    Explanation:

    The Prosecution has the greatest amount of burden of proof because they are bringing forth the accusations.

    The gov. can not be the defendant in this situation, and I am sure they can not be the jury (because they are supposed to be of your peers). I also do not think it can be the judge because the judge has to impartial during the hearing.
