Hemlock Holmes lives in a contributory negligence state. Holmes drank four ounces of straight gin in thirty minutes and became intoxicated. Then on an unlighted street, he walked without looking from between two parked cars in front of a speeding car. The driver was unable to stop before hitting Holmes. Holmes sued to the driver to recover damages for his injuries. Will Holmes win
