When an employee is treated differently from others due to race, color, religion, gender, or national origin it amounts to disparate treatment.

They are treated differently than others just because their skin color, religion, or origin aren't the same as others'. Although this disparate treatment is not necessarily always negative, it still happens a lot in contemporary society, now more than ever.
