You are a defense attorney in a high-profile case with a celebrity. The defendant has been caught with a large quantity of narcotics and weapons. There is little question that he is guilty and you expect that he will admit his wrongdoing and avoid a trial. Based on these facts, what is your best option at the preliminary hearing stag?

    According to the U. S. Constitution under the Sixth Amendment, anyone that is accused of a criminal offense has the right to a public trial.

    The general public including the media have a First Amendment interest in open court proceedings, although these rights are secondary to the interests of the parties to the case.

    The defendants however can waive their right to a public trial. A waiver is a voluntary relinquishment of some known right or privilege. If a celebrity defendant waives their right to a trial then they are able to avoid a lot of media attention. However, they cannot compel a private trial.
