Donny lists his car for sale in the classified ads of the local newspaper. Marie looks at the vehicle and is interested in buying it. She agrees on a price with Donny, but asks him to hold the car until she can talk with her husband. Donny agrees in writing to hold the car for 24 hours. When Marie and her husband return the next day they discover Donny had sold the car to someone else for $100 more than Marie offered to pay. Marie claims that Donny breached a contract to hold the vehicle for 24 hours. Is Marie correct?

    in the case of Donny and Marie, there truly was a contract but it wasnt legally binding which is one of the characteristics of a contract. it can also be called the object of the contract.
