David Delta rents an apartment on the second story of a building. The landlord leases space on the first floor below David's apartment to a cleaning company that mixes its cleaning chemicals in the leased space. The fumes from the company's chemical mixing drift up into David's apartment, even when the windows are closed. They cause David to suffer severe nausea and headaches, and he cannot sleep in the apartment. David's girlfriend and friends also refuse to come over due to the strong odors. If David brings a claim for nuisance, is he likely to win?

    Explanation: We need to define what "Nuisance mean"and Give an example of nuisance in the fury David is facing in his apartment.

    What is Nuisance?, a nuisance is a person or something that constitute a disturbance to a person or environment.

    The nuisance that David is facing in his apartment is the fumes of the mixed chemicals from his neighbors which is the company below him in the story building.

    What will make him to win if he files for a nuisance claim?

    From the above passage, the fumes of these mixed chemicals causes severe headaches to David and makes him inconvenient in his apartment. With this, his claim would be justified because of the injury that he is exposed to on a daily bases which can even lead to very sever fever not to also mention how discomforting he is to his closed ones when they come visit him in his apartment.

    Definitely, if he files a claim of nuisance we will win and win again.
