We all have a social duty that requires us to manage our affairs so as to not injure another. this duty applies even when we act through an agent.

    That statement is true

    This means that we shall not advise other people to do something that would damage our social obligations just as much as we should not do it ourselves.

    Even in the current legislation, an agent who involved in a criminal scandals could receive equal punishment even though that person was not directly involved.
