    I believe the answer is: The eight amendment

    The eight amendment prohibits the Federal government from imposing excessive bail, unreasonable amount of fine during violation, and criuel/unsual punishment (Such as painful torture, the killing of family/relatives) even to the defendant that is proven guilty.
