    The correct answer is B. Smith would be the plaintiff and Henderson will be the defendant.

    Smith would be the plaintiff because that's the name for the person who is initiating the lawsuit in a civil case. Prosecution is when the country does it in a criminal court. Henderson would be the defendant and would have to provide a preponderance of evidence that Smith is incorrect.
