Imagine that a few months after the court's decision two Pagan gang members push past the bouncer and enter Pub Zone wearing their gang colors. Once again, Kerkoulas fails to call the police or otherwise act. The gang members sit quietly at the bar. Meanwhile, a clumsy patron trips over her own high heels and injures her shoulder on the jukebox. Is Kerkoulas liable for her injuries?

    From the passage above, it states that the Patron was " Clumsy", clumsy means doing something or handled something in an awkward manner, it was her lack of carefulness that resulted her to trip, it is not kerkoulas that made her or fall, neither was he beside her that made her to fall, also it was not the presence of the pagan gang members that made her to fall.

    So it was not kerkoulas or the gang members that made her to fall, but her clumsiness and lack of concentration that resulted to the trip.
