There was a study that says that in more than 300 homicides in a major American city, it was found that more than half of the suspects were released before reaching trial.

When the situation arises where an individual is charged, the accused will have a bail hearing within 24 hours of arrest to determine if they should be kept in custody or released while they wait for their trial. A bail hearing is actually a meeting held by a judge in order to decide if the accused should be released from jail before their trial.

And the term ‘bail’ on the other hand is defined to be the release of an accused from jail before trial. It is already the prerogative of the victim / family if they wish to attend the hearing. The venue of the bail hearings are to be held in courts. Most of the times, they are held in the Superior Court of Justice for homicides. Trials are held in the Superior Court of Justice.
