In a situation where the injured person or the dead person is an innocent bystander, the police department will be held liable because the fact that the officers on duty are trying to apprehend a fleeing suspect does not give them the right and opportunity to cause serious injury or death of innocent people on the road. Officers have the duty to protect people's lives and properties and do not have the right to cause death or injure other road users during the pursuit of an offender. They are to exhibit reasonable care in performing their duties.
