Motion for judgment on the pleadings.

    Explanation:

Motions for judgment on the pleadings means either of party may file a motion for judgment on the pleadings when no answer has been filed, due to the fact that the pleadings may as well disclose that there are no available material issues of fact to be settled thereby making the party to be entitled to judgment as a matter of law. Although a party may as well make some request to the court my asking the court to rule in their favor based on the pleadings on file, without trying to accept any evidence due to the fact that the outcome of the case may eventually rests on the court's interpretation of the law which is why motion for judgment on the pleadings is a fail-safe for parties who fail to plead failure to state a claim as an affirmative defense.
