inability to perform the contract (a breach)

    Explanation:

Seeing that Kaboom Ltd. won't be able to deliver what it had been asked according to the law it is legally a failure to fulfill any contractual obligation. This is known as a "breach" of the contract. What had been demanded is not going to arrive on time, what can be seen as something that does not perform in accordance with the terms of the agreement.
