Jerry has been tried and convicted of assaulting his friend Kenny. There were no other eye witnesses and Kenny refused to testify in court against Jerry. Jerry claims his conviction should be overturned. Is he correct (Is this constitutional? yes or no. Include the amendment #, article #, etc) ?

    The case should be overturned because if he wont testify against then that must mean a lot, and if there was no eye witness, then it's Jerry's word against Kenny's.
