this is because the Trail of Tears occurred after the Cherokee Indians brought Georgia to the supreme court to state that because they were not citizens of Georgia, the Indian Removal Act didn't apply to them, to witch the SC sided with them, but Georgia kicked them out and made them walk to western reservations on what is known as "The Trail of Tears"
