What part of the Constitution does President Lincoln say gives him the power to free the slaves?

    President Lincoln used his executive power he had under the constitution to free slaves. As Commander in Chief under the US constitution he issued the Emancipation proclamation in January 1, 1863. He stated the military necessity of his action.
