    9th amendment

    Explanation:

The 9th amendment basically stated that any rights that are not written under the constitution will be given to the people, not the government.

The constitution does not give the government with the right to obtain proof/evidence without structured procedure. Because of this, the protection against such action is given to the people and the citizens of united states couldn't be convicted unless the government use a legal and proper method throughout the process.
